Acceptance of Terms
By accessing or using CountFlow (“the Service”), operated by OpenPark Technologies (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
Service Description
CountFlow is an AI-powered traffic video analysis platform. Users upload roadside camera footage, define regions of interest, and receive automated traffic analysis reports including vehicle counts, classification, temporal trends, and annotated video output.
Account Registration
To use CountFlow, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access to your account.
Credits and Payments
CountFlow operates on a credit-based system. Credits are consumed based on the duration of video analyzed. Key terms regarding credits and payments:
- Credits are purchased in packages and are non-refundable once purchased.
- All payments are processed securely through Stripe. We do not store payment card information.
- Purchased credits do not expire and remain available as long as your account is active.
- We reserve the right to modify pricing at any time. Existing purchased credits will not be affected by pricing changes.
Acceptable Use
You agree not to:
- Upload illegal, harmful, or inappropriate content, including footage obtained without proper authorization.
- Attempt to abuse, exploit, or reverse-engineer the API or any part of the Service.
- Use the Service for surveillance, tracking individuals, or any purpose that violates applicable privacy laws.
- Interfere with or disrupt the Service's infrastructure or other users' access.
Intellectual Property
Your Content: You retain full ownership of all videos and data you upload to CountFlow. By uploading content, you grant us a limited license to process it solely for the purpose of providing the analysis service.
Our Platform: The CountFlow platform, including its software, AI models, user interface, branding, and documentation, is the intellectual property of OpenPark Technologies and is protected by applicable copyright and trademark laws.
Data Processing
Our handling of your personal data is governed by our Privacy Policy. By using the Service, you acknowledge and agree to our data processing practices as described therein.
Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law:
- We do not guarantee the accuracy, completeness, or reliability of AI-generated analysis results.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.
Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited upon account termination initiated by either party.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
